Right of Withdrawal

The User, acting as a consumer, when making a purchase on the Website, has the right to withdraw from said purchase within 14 calendar days without giving any reason.

This withdrawal period will expire 14 calendar days after the day on which the User or a third party authorized by the User, other than the carrier, acquires physical possession of the goods purchased on the 360mobile Website, or, in the case of goods that make up a single order being delivered separately, 14 calendar days after the day on which the User or a third party authorized by the User, other than the carrier, acquires physical possession of the last of those goods that made up a single purchase order, or, in the case of a service contract, 14 calendar days after the day the contract is concluded.

To exercise this right of withdrawal, the User must notify their decision to 360mobile through the contact spaces provided on the Website, clearly and unequivocally expressing their intention to withdraw from the purchase contract. The User may use the model withdrawal form provided by 360mobile; however, its use is not mandatory.

In the event of withdrawal, 360mobile will reimburse the User all payments received, including delivery costs (except additional costs for alternative delivery methods), no later than 14 calendar days from the date of the withdrawal decision, using the same payment method used for the original purchase.

The User must return the products no later than 14 calendar days from the withdrawal decision and must bear the direct cost of return. The User will be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature and functioning of the goods.

Exceptions to the right of withdrawal apply as per Article 103 of Royal Legislative Decree 1/2007, including: personalized products, perishable goods, unsealed audio/video recordings, and sealed hygiene/health products that have been opened after delivery.

No refund will be made if the product has been used beyond merely opening it, is not in the same condition as delivered, or has suffered damage after delivery. Products must be returned with all accessories, original packaging, instructions, and a copy of the purchase invoice.

Return of Defective Products or Shipping Error

If the User considers that, at the time of delivery, the product does not conform to what was stipulated in the contract or purchase order, they must contact 360mobile immediately to report the non-conformity (defect/error) via: ventas@360Mobile.es

The User will be informed on how to proceed with the return. Once returned, the products will be examined and the User will be notified within a reasonable period whether a refund or replacement is appropriate.

The refund or replacement will be processed within 14 days following confirmation that the return of the non-conforming item is appropriate.

The amount paid for defective products will be fully refunded, including delivery costs and return costs incurred by the User, using the same payment method used for the original purchase.

Guarantees

The User, acting as a consumer, enjoys guarantees on products purchased through this Website under the terms legally established for each type of product. 360mobile is liable for any lack of conformity that becomes apparent within two years (or any longer period defined by applicable law or the commercial guarantee of vivoonlinestore) from delivery of the product.

Products are deemed to conform to the contract provided that they match the description given by 360mobile, are suitable for ordinary intended uses, and exhibit the usual quality and performance expected of the same type of product.

When products do not conform, the User must proceed as indicated in the Return of Defective Products or Shipping Error section. Note that non-homogeneous characteristics deriving from the nature of the material used in manufacturing are not considered a defect.
